This website is operated by My Drift Kart. By visiting our site or purchasing from us, you agree to these terms. Please read them carefully, especially the Rider Safety, Assumption of Risk and Limitation of Liability section below.

Online Store Terms
By agreeing to these terms you confirm you are at least 18 years of age. You may not use our products for any illegal or unauthorized purpose. We reserve the right to refuse service to anyone for any reason at any time.

Products and Pricing
Prices are subject to change without notice. We make every effort to display product colors and images accurately but cannot guarantee your screen's display will be accurate. We reserve the right to limit quantities and to discontinue any product at any time. Descriptions and specifications are provided by the manufacturer.

Orders and Payment
By placing an order you confirm that the payment method is yours or that you are authorized to use it, that the billing and shipping information you provided is accurate, and that you are the person who will receive the Product or have authorized that person. We may cancel or hold any order we believe to be fraudulent or unauthorized, and we may require verification before shipping. Orders ship with tracking and delivery confirmation; a carrier delivery scan (or signature, where the carrier obtains one) to the address you provided is proof of delivery.

Returns, Cancellations and Refunds
Returns are governed by our Return & Refund Policy, which is part of these Terms. In summary: return authorization is required before any item is sent back; return requests must be made within 30 days of delivery; change-of-mind and wrong-color returns carry a 20% restocking fee and customer-paid return shipping; orders may be cancelled within 12 hours of purchase. By completing checkout you acknowledge that you have read and accepted these return terms.

Chargebacks and Disputes
If you have any problem with your order — damage, a missing part, a delay, or a change of mind — you agree to contact us at support@mydriftkart.com first and allow us 5 business days to resolve it before disputing the charge with your bank or card issuer. Every order is shipped with tracking and carrier delivery confirmation. We respond to all payment disputes with full documentation, including order details, the terms accepted at checkout, delivery confirmation, and all correspondence. Chargebacks filed for items that were delivered as described, or filed without first contacting us, are contested as invalid, and we reserve the right to recover the amount of any chargeback found to be without merit, together with associated fees, through all lawful means.

Accuracy of Information
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors and to cancel orders if any information is inaccurate at any time without prior notice.

RIDER SAFETY, ASSUMPTION OF RISK, AND LIMITATION OF LIABILITY

Independent Reseller. My Drift Kart is an independent retailer of the 24V Electric Drift Go-Kart (the "Product") and is not the manufacturer. The Product is designed, manufactured, tested, labeled and packaged by a third-party manufacturer, which is solely responsible for its design, materials, workmanship, owner's manual, warning labels, and compliance with applicable safety standards. Nothing on this site should be read as a representation by us about the Product's design or engineering beyond the specifications supplied to us by the manufacturer.
Nature of the Product. The Product is a motorized ride-on vehicle capable of speeds up to approximately 11.2 mph and designed to drift and slide. Riding any motorized vehicle involves inherent risks, including but not limited to loss of control, collision, tipping, falls, and contact with objects, vehicles, animals or other people, which can result in serious injury, permanent disability or death. These risks cannot be eliminated regardless of the care taken to avoid them.
Age and Supervision. The Product is intended for riders ages 6 and older with a maximum rider weight of 150 lb. It is not a toy for unsupervised play. A responsible adult must supervise every ride. The purchaser is solely responsible for determining whether a rider has the physical ability, coordination and judgment to operate the Product safely.
Required Safety Practices. By purchasing the Product you agree that every rider will: (a) wear a properly fitted helmet at all times, and protective gear including knee and elbow pads is strongly recommended; (b) be secured with the 5-point seat belt before the Product is powered on; (c) ride only on flat, dry, paved or hard surfaces in private areas free of traffic, obstacles, slopes, water, loose gravel, sand, or drop-offs; (d) never ride on public roads, streets, sidewalks, driveways that open onto a road, parking lots with vehicle traffic, or near swimming pools or bodies of water; (e) never ride at night or in low visibility, in rain or on wet surfaces; (f) begin in low-speed mode until fully comfortable with the controls; (g) never carry passengers, tow anything, or exceed the weight limit; (h) never modify the Product, its battery, motors, controller, or speed settings in any way; and (i) read and follow the owner's manual and all warning labels in full before first use.
Assumption of Risk. By purchasing the Product, you, the purchaser, on behalf of yourself and any rider for whom you are the parent or legal guardian, acknowledge that you understand the risks described above and that you voluntarily assume all risk of injury, illness, death, property damage, or other loss arising from the use of the Product, whether caused by the inherent risks of riding, by the rider's actions, by the condition of the riding surface, or by any other cause, to the fullest extent permitted by law.
Release and Waiver. To the fullest extent permitted by applicable law, you release, waive, and discharge My Drift Kart, its owners, officers, employees, contractors, suppliers, and agents (collectively, "we," "us," or the "Company") from any and all claims, demands, causes of action, damages, and liabilities of any kind, whether known or unknown, arising out of or related to the use, misuse, or inability to use the Product, including without limitation claims for bodily injury, emotional or psychological harm, property damage, or wrongful death, and including claims arising from the Company's ordinary negligence.
Indemnification. You agree to defend, indemnify and hold harmless the Company from any claim, loss, liability, cost or expense, including reasonable attorneys' fees, brought by any third party (including any rider, other minor, bystander, or property owner) arising out of the use of the Product purchased by you, your failure to supervise a rider, your failure to follow the safety practices above, or any modification of the Product.
Limitation of Liability. To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including lost profits, loss of use, or emotional distress, arising from the Product or these Terms, even if advised of the possibility of such damages. In no event shall the Company's total aggregate liability arising from the Product exceed the amount actually paid by you for the Product.
Disclaimer of Warranties. Except for the express 30-Day Quality Guarantee stated in our Return & Refund Policy and any Protection Plan purchased, the Product is provided "as is," and the Company disclaims all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some states do not allow limitations on implied warranties or the exclusion of certain damages, so some of the above may not apply to you; in those states, the Company's liability is limited to the greatest extent permitted by law.
Misuse Voids Coverage. Any damage or failure resulting from riding on prohibited surfaces, exceeding the weight limit, carrying passengers, modification, improper charging, water exposure, or failure to follow the owner's manual is not covered by the 30-Day Quality Guarantee or any Protection Plan and is the sole responsibility of the purchaser.
Battery Safety. The Product contains a rechargeable battery. Charge only with the included charger, indoors on a hard non-flammable surface, never unattended overnight, and never while the rider is in the Product. Do not charge or store a damaged, swollen, or leaking battery; contact us immediately.
Governing Law and Disputes. These Terms shall be interpreted and enforced in accordance with applicable law. Any dispute arising from the use of this website, a purchase, or the Product shall be resolved through appropriate legal procedures in a competent jurisdiction.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision shall be enforced to the maximum extent permitted by law.
Acknowledgment. By completing a purchase you confirm that you are at least 18 years of age, that you are the parent or legal guardian of any minor who will ride the Product, that you have read and understood these Terms including the Assumption of Risk and Release, and that you agree to be bound by them.
